MDVA Legislative Successes

MDVA has been recognized as one of the most successful small industry advocacy organizations in the state.  We have an aggressive, forceful, hard-hitting team at the Capitol every day fighting on behalf of our members.  Each and every year MDVA achieves success on behalf of our members by working to defeat legislation that hurts our businesses and pass legislation that benefits our industry. In these challenging economic times, MDVA is critical to the very survival of our businesses!  In the past ten years, MDVA has achieved: 

P.A. 200, of 2010, reimburses businesses for Michigan Business Tax payments that included tobacco taxes in the gross receipts component

Defeated HB 6219 – 6220 of 2009, to repeal the sales tax exemptions on vended products

P.A. 433 of 2008, phases out tobacco taxes from gross receipts in Michigan Business Tax

P.A. 458 & 459 of 2008, tightens enforcement on illegal tobacco tax trafficking

Defeated HB 5255 of 2007, to repeal the sales tax exemptions on vended products

Defeated HB 5252 of 2007, to eliminate the cigarette stamping discount, and repeal the tobacco products tax bad debt deduction

Defeated HB 4381-4382 and SB 317-320 of 2007, to repeal the sales tax exemptions on vended products

Defeated HB 4385 and SB 328 of 2007, to increase the cigarette and OTP tax

Defeated HB 4912-4913 and SB 587-588 of 2005, to repeal the sales tax exemptions on vended products

P.A. 474 of 2004, tightens enforcement on illegal internet cigarette sales

P.A. 286, of 2003, allocable share amendment to the MSA enforcement

P.A.  607, of 2002, created a tobacco tax bad debt deduction

P.A. 503, of  2002, increased  tobacco wholesalers discount

P.A. 417, of 2000, exempted vended pop from sales tax

Other highlights include:

Sales tax exemption for all vended snack foods and beverages in sealed containers.

Cigarette stamping legislation allowing for tax payment terms for wholesalers and collection allowance increase.

Tobacco tax bad debt deduction for wholesalers.

Enforcement efforts on gray market cigarettes, illegal internet cigarettes, and untaxed tobacco products

Product sell-through provision in fire safety compliant cigarette standard

Phase out of tobacco taxes in MBT gross receipts component for wholesalers

Defeat efforts to characterize sales tax exemption for vended products, tobacco tax collection allowance, and tobacco tax bad debt deduction as “loopholes” slated for elimination, year after year!

Defeat efforts to increase taxes on cigarettes, OTP, moist snuff tobacco, little cigars.
